WHAT ARE SOME OF THE LEGAL ISSUES RELATED TO INFERTILITY AND INFERTILITY TREATMENTS FOR HEALTH INSURANCE LAW?

In recognition of National Infertility Awareness Week, April 19-25, 2015, we will discuss some legal issues associated with infertility and infertility treatments as they relate to Health Insurance Law.

Pennsylvania law does not law require insurance carriers to offer coverage for infertility treatments. There is also no Federal mandate for coverage of infertility issues. Therefore, determining whether your health insurance plan covers infertility requires a review of the policy description and the plan guidelines. If your plan is an ERISA plan, your infertility may qualify as an illness under the plan parameters but an application may be required.

When dealing with legal issues as a result of infertility or infertility treatments, you should speak to an attorney experienced in the knowledge of Assisted Reproductive Technology Law as well as Health Care Law. All of these potential legal issues may be applicable to your personal situation and understanding the law and your options is paramount in the forefront of your journey.
